Hiring a Debt Settlement Attorney

Why hire a Debt Settlement Attorney? A lot of people are faced with a mountain of credit card debt they can never overcome. In this case, an attorney might be your best option.

So why not do the negotiating yourself? There are several reasons. The reality is that this is a complex topic. There are plenty of legal loopholes that most people aren’t aware of that a lawyer knows about. Their knowledge debt laws and its many loopholes will help you lower the amount you owe, and the date you have to pay it by.

Also, in many instances the companies might refuse to negotiate with you altogether. However, they will have much more respect for an attorney. If a lawyer is willing to work with you they know you probably have a legitimate case, and they will have far more respect for their knowledge of the law.

In addition, the lawyer will keep a record of all communication between you and the company. This might be important if there are further legal issues down the road.

How much debt can you get rid of? Assuming you hire a debt settlement lawyer, you can get as much as seventy percent forgiven. Many people are able to get rid of a minimum of sixty percent of their unsecured debt.

Are there requirements on who can use a lawyer? There are; you generally need a minimum personal debt of $10,000 in order for an attorney to work with you. And the debt has to be unsecured.

You also need the wherewithal to make payments. If you are completely broke, then bankruptcy would be your best option. However, avoid this route if at all possible as the rebuilding of your credit is lengthly.

Why not just not make your payments at all? Some people simply avoid making payments for 7 years, in which case the debt is wiped clean. The problem is, this will kill your credit score. You will not be able to obtain traditional financing for a long time. And the reality is if you can make some payments, it is the responsible thing to do.

So do not file for bankruptcy. Even if you aren’t sure you can use a debt settlement attorney, at least talk with one and find out if you meet their criteria. Even if you can’t pay off the entire debt, when companies see that you are at least attempting to make your payments, it dramatically helps your credit score.
